Conditions of Use

ARTICLE 1 - Introduction
The terms and conditions of the services provided by ANAKARAAS.COM and the rules governing the use of the Websites are governed by this user agreement and other rules contained in the Website. The User undertakes to comply with this Agreement from the moment he or she has entered into or has begun to use the Web Site to create a Service Request or Profession Profile through the Website. If the terms do not apply to you, please do not use the Website. ARTICLE 2 - DEFINITIONS:
In the text of this Contract;
a) "ANAKARAAS.COM" Anakara Construction and Tourism Inc.,
b) "Web Site" http://www.anakaraas.com web site,
c) "User" The person who use the Web Site for any reason,
d) "Member" means the User who sets a password for himself / herself according to the terms of acceptance of this User Agreement by taking e-mail,
e) Service through the "Service Area" Web Site Service, real or legal person who sends the request,
f) "Service Provider" means a person, organization or legal entity that establishes a Vocational Profile through the Web Site to provide the Service and approves the contract of providing the Member Service (if the service provider is a legal entity, the term "service provider" It covers.)
g) "Profession Profile" means the profile of the service created by the Service Provider on the Website for the purpose of giving a bid for the Service Request made by the Service Providers,
h) "Service Request" ANAKARAAS.COM directs service from the relevant Profession Profiles to the Service Provider according to the status of compliance by the Service Area in terms of some services according to the service demand or quality published on the Web Site for the purpose of receiving Bids from one or more Service Providers demand,
i) "Proposal" means the offer by the Service Provider, in response to a Service Request, to provide services for a certain amount,
j) In the "Fixed Price" Reservation System, the standard unit price to be paid to the Service Provider by the Service Area and forwarded to the Service Provider through the Web Site upon the service provider's orientation,
k) Approval of the Service Request through the Reservation System in respect of the acceptance of the Offer submitted by the Service Provider through the System by the Service Providers through the System or some services according to its nature,
l) "Entrance fee to the system" is the standard unit price collected for a pre-announced fee for service via the Website,

n) "Contract" means the User Agreement.

ARTICLE 3 - SERVICES PROVIDED BY ANAKARAAS.COM AND SALES PROCEDURES"ANAKARAAS.COM" shall ensure that the Service, Product or Service request information that the Service Provider and the Service Taker are building their own contents in accordance with the content notified to them and in accordance with the provisions of this Agreement. "ANAKARAAS.COM" is solely a platform, not the owner or provider of services located on the Web Site."ANAKARAAS.COM" is a platform that sells online via the internet and a distant sales contract is prepared as a separate contract; "ANAKARAAS.COM" distance sales contract.

ARTICLE 4 - TERMS OF USE
Membership System
• Membership to the Web Site is free of charge for the service provider. Members may submit more than one Service Request at the same time through a single Member account. ANAKARAAS.COM is not obligated to check the accuracy and update of the information in question. • Usage rights, user name and password for membership can not be transferred to others.

Service Request Formation• Any User who is at least 18 years of age and has the power to appeal may create a Service Request by properly and completely filling in the information requested in the registration form pursuant to the terms of this Agreement.• To provide a complete, accurate, and clear description of the service (such as the nature, characteristics, quality, measures, performance and place of delivery and duration of the requested job) required to establish a valid Service Request, and its content complies with the requirements set forth in this Agreement is a must.• ANAKARAAS.COM publishes the Service Request after it has been audited, if it deems it appropriate. However, the full responsibility for the content of the Service Request belongs to Service Domain.

Reservation System
• ANAKARAAS.COM provides a reservation system which, according to its nature, provides regular or one-time service provider guidance for certain services on a standard tariff that is appropriate for the days and times set by the Service Area.
• In services subject to the reservation system, the Service approves the Service Request. The Service Area may display the Serving Details forwarded to it [1] days prior to the reservation date on the request detail page. If the Service Provider does not accept the Service Provider directed to him / her, he / she will request to change the Service Provider by sending an e-mail to info@ANAKARAAS.COM before the due date. Otherwise, the Service Provider is deemed to have been accepted.

Reservation System Change and Cancellation Rules
• The Service Provider may change or cancel the day or time of service by sending an e-mail to info@anakaraas.com up to 24 hours prior to the time of the Service Request.
• Business cancellation must be done via communication channels notified via the Web Site and can not be done outside of the Web Site.

Creating Profession Profiles
• Any person who is at least 18 years of age and has the power to appeal and may complete the information requested in the registration form accurately and completely and obtain a Service Proficiency by creating a Vocational Profile in accordance with the terms and conditions accepted after the terms of this Agreement and the Member Service Contract have been approved.
• In order to create a Profession Profile, the information required at the time of registration such as name, trademark, title, contact information, tax number, tax number should be given completely and clearly. Entry of documents and references such as permit, license, certificate, service authorization certificate, trade registry document, room registration, etc. must be made in addition to the license (if any) and qualification, experience and ability to provide services related to the Profession Profile.
• The terms of the Service Provider and the Service Provider's obligations are detailed in the Member Service Contract, which must be approved prior to profiling. It is the responsibility of the Service Provider to transmit all other documents, including invoices and receipts, which must be provided as a result of the service, to the Service Area together with the performance of the service within the scope of the legal regulations. ANAKARAAS.COM does not have any responsibility for the procurement of such documents.

Offer:
• The Service Provider proposes to submit a Service Request through the Web Site for a Service Request sent to it, at the price indicated in the Offer, specified in the Service Request. The winning bid is the bid accepted by the Service Domain.
• Offer submission means that a binding legal agreement with the Service Provider is made to provide the service at the price stated in the offer if accepted by the Service Domain. The prices quoted by the Service Provider on the basis of the relevant business discovery may change, in which the offer price shall be updated by agreeing to the parties.
• Any changes to the service subject to an approved Proposal, other than the Booking System, must be agreed on the Website jointly by the Service Provider with the Service Area.
• The quotations are valid and offering for the period specified by the Service Providers. ANAKARAAS.COM has no responsibility for the withdrawal of the Offer the Service Provider has indicated before.
Vocational Profile, Service Claims and Content of Proposals
• Profiles, Service Requests and Proposals and information, documents and statements given to the parties shall not (a) infringe any third party's intellectual property rights or other rights, such as copyright, patent, trademark, (b) violate any applicable law or secondary legislation (such as those relating to export control, consumer protection, unfair competition or misleading advertising, etc.); (c) a declaration that is contrary to public morality and public order, which is honest and inaccurate, deceptive, misleading or exploiting the experience and information deficiencies of third persons, which endangers life and property, destroys public health, affects the sick, it will not include promotional statements; (d) will not be degrading, defamatory, threatening or harassing; (e) not include obscene or child pornography, and (f) contain harmful software programs such as viruses, Trojan horses, or any other harmful computer programming practices aimed at harming any system, data, or personal information. Otherwise, ANAKARAAS.COM shall not be liable and the responsibility belongs to the relevant Service Provider or User.
• All responsibilities related to Profession Profiles, Service Requests and Proposals are the responsibility of the Service Provider, Service Provider or User and ANAKARAAS.COM has no responsibility.

Payment:
• Service Sites may pay the price of the offer they accept directly to the Service Provider directly after the service has been performed or may make an online payment online via the Online Payment System or through a bank card, credit card or similar payment instrument and other payment systems. • The Service Provider collects from the Service Area on the Proposal that the order price has been notified to ANAKARAAS.COM for the receipt of the receipt or invoice, except for those who are paid by Online Payment System.
• Where the online payment system is intermediated by the payment institution cooperated by ANAKARAAS.COM; the relationship between the payment institution and the Service Provider and the Service Provider shall be independent of ANAKARAAS.COM and shall be liable to the payment institution for the fulfillment of the obligations stipulated by the relevant legislation.
• If the service payment voucher / invoice or other documents required to be regulated when the Online Payment System is used are regulated by the relevant Service Provider if they are obliged to regulate it according to the relevant legislation. The invoice / voucher or other documents related to said service shall not be requested from ANAKARAAS.COM and ANAKARAAS.COM shall be obliged to invoice the Service Providers for the commission fee or communication right only in relation to the services provided by ANAKARAAS.COM.
• In the event that the Service Sites make their service fees via Online Payment System, ANAKARAAS.COM may charge the fee if requested by the Service Areas or may instruct the agreed payment institution to do so. ANAKARAAS.COM reserves the right to instruct the payment institution to not send the relevant amount to the Service Provider if the payment made by the Online Payment System is incomplete or defective in the relevant Service Area, if the Service Request can not be found or if the service is canceled, and / or reserves the right to cancel the relevant Service Request.
• If agreed with the payment institutions for the Online Payment System, ANAKARAAS.COM is only obliged to send the relevant instructions to the relevant organization for the payment of the related fees. It is the obligation of the relevant payment institution to keep the User information and all other necessary information secure and secure by the relevant payment institution and to perform the transactions safely.

Use of Service Charge / Change Right
• The Service Area has the right to withdraw from the contract without any justification and without penal terms within 14 days after the agreement with the Service Provider, provided that the service has not been executed. This right is reserved in the Reservation System 24 hours before the service start time. It is sufficient for the notification of the use of the right of withdrawal to be notified in writing to [info@anakaraas.com] in the subject heading [statement of cancellation] within this period.
• The Service Charge will be made by the relevant Service Provider. The service can not be requested from ANAKARAAS.COM.
• ANAKARAAS.COM accepts no responsibility for any disputes arising out of or relating to matters such as payments, discounts or refunds between the Service Provider and the Service Provider.
• Payments made with payment instruments other than the Online Payment System option are made directly by the Service Provider.
• ANAKARAAS.COM accepts no responsibility for any disputes arising out of or relating to the Service, such as cancellation, discount or refund of fees, between the Service Provider and Service Providers.

Service Responsibility, Non-Guarantee and Independence of Relationship• ANAKARAAS.COM has no responsibility for the offer, requirement, acceptance, contract and payment stages between the Service Area and the Service Provider. ANAKARAAS.COM does not and can not guarantee or provide compliance with the Service Provider and the Service Provider in the Service Area, nor will Service Provider provide or maintain the Service Provider's business at any time and place at any time. Service areas should do the necessary research about the service provider themselves.• The Service Provider shall bear all responsibilities for the services to be received from the Service Provider through the Website. ANAKARAAS.COM has no liability.

• ANAKARAAS.COM does no endorsement or recommendation of the Service Provider or its services, nor does it guarantee the performance or the results or quality of services rendered. ANAKARAAS.COM can rank and categorize Service Providers through some algorithms in the system, such as Member Schedules and Member Comments, and can highlight some Service Providers because they are highly liked, preferred or satisfied. However, this does not constitute an endorsement or guarantee given by ANAKARAAS.COM.

• ANAKARAAS.COM has no responsibility for any damages that the Service Providing may give to the Service Provider or the third party at any time during the service provided by the Service Providing and not between the Service Provider and the Service Provideing.
• At ANAKARAAS.COM, only the Service Providers who are appropriate to the Service Areas from the Profession Profiles registered in the system according to the availability of the Service Providers are directed in the Reservation System. ANAKARAAS.COM will only show the necessary dedication to provide services at the specified time and at the stated Fixed Price.
• ANAKARAAS.COM does not make any guarantees or commitments in respect of the reliability of Service Providers, such as being competent to provide the related service, providing or giving services on time, being secure and error free, sufficiency or reliability of the results obtained from service, or service quality being responsive to expectations. ANAKARAAS.COM only tries to negotiate with the relevant Service Providers regarding the services contained in the reservation system and tries to perform reference checks with the information provided by the Service Provider, when deemed necessary. Even if confirmed by ANAKARAAS.COM, reference controls will not determine the future behavior of a Service Provider.
• In the reservation system, the service provider shall not be liable for any errors resulting from the Domain or the Service Provider (such as incorrect date, failure of the Service Area to be in the service at the service start time, service provider's failure to perform service at the relevant date and time, etc.) there is no liability. ANAKARAAS.COM will make the utmost effort to prevent such situations from occurring. However, it will not pay any compensation to the Service Provider or Service Area for any errors or damages that occur.

• The correctness of the information or statements stated in the Profession Profile by the Service Provider is committed by the Service Provider and ANAKARAAS.COM has no liability.
• All permits, approvals, control certificates, licenses, etc. required to be provided in accordance with the applicable legislation with respect to the service. The responsibility for the document belongs to the Service Provider and all other administrative, legal and criminal liabilities that may arise are attributable to the Service Provider. ANAKARAAS.COM and third parties are liable for the damages caused by and / or caused by this cause and the liability for compensation for any damages belongs to the Service Providers.
• ANAKARAAS.COM does not represent or warrant that the information received from the national, local or other government agencies or third parties is accurate or up-to-date or current on the date Service Domain controls the information in question.

• ANAKARAAS.COM is not liable for any problems or damages that may arise between the Service Provider and the Service Providing (s) due to the sharing of the name, address and telephone number of the Service Areas registered in the system with Service Providers for the creation of an offer or related service.
• Service Area information is shared by the ANAKARAAS.COM for the provision of the service with the Service Provider or for the creation of an offer. This information sharing aims to provide a smooth service. In the event that the said information is not also approved by the Service Provider, Service, such as advertising, marketing, personal, etc. in any way, for any occasion or purpose, be shared with third parties or transfer or serving the service area(s) that may arise between cut problems or damages that may occur.

• ANAKARAAS.COM has the intellectual rights of all data that will be generated by using the Web Site. • User comments / evaluations related to the Service Provider are published as ANAKARAAS.COM can see for all Users upon approval, control and correction required. ANAKARAAS.COM has the right to amend or publish the aforementioned comments. ANAKARAAS.COM reserves the right to temporarily or permanently change or terminate the Web Site (or a portion thereof) at any time, without notice or prior notice.
• In order to preserve the integrity of the Website, ANAKARAAS.COM may, at its sole discretion, prevent users from accessing the Web Site of certain Internet Protocol addresses.

Service Area Obligations
• Any administrative, legal, and criminal liability arising from the failure of Service Domain to comply with the terms of this Agreement is directly attributable to Service Domain.
• The Service Provider may accept only one Offer for Service Request. Acceptance of the offer means that a legally offering agreement has been made to pay the Service Provider if the Service is provided.
• The Service Provider agrees to pay the Service Providing the amount specified in the Offer or the Fixed Price for the services rendered to the Service Provider when the Service Provider accepts the Offer or approves the Service Claim in the Booking System.
• The Service Provider agrees to inform ANAKARAAS.COM in case of change of the previously shared credit card information, if it chooses to collect the related service amount from the credit card.
• The Service Provider acknowledges that ANAKARAAS.COM has the authority to store and share with the system operators in the payment system of which the agreement is agreed, to the extent that credit card information is permitted under the legislation. ANAKARAAS.COM is not responsible for the disruptions that may occur in the contracted payment system.

Authorities Given to ANAKARAAS.COM
• ANAKARAAS.COM may suspend or stop the operation of the system temporarily. Users shall not pay any usage fees to ANAKARAAS.COM for the use of the Web Site, and shall not be subject to any requests due to suspension of the system from ANAKARAAS.COM for that reason.
• ANAKARAAS.COM or its cooperating payment institution may temporarily suspend or stop the possibility of online payment of related users' credit card due to Service Area and Service Provider transactions which cause security suspicion. There is no responsibility for the users of ANAKARAAS.COM or the 3rd person for this reason.
• ANAKARAAS.COM or the payment institution it cooperates with, has the right to interrogate the limit sufficiency of the card subject to the Online Payment System before approving the Service Request within the Reservation System or by paying the site membership or the monthly fee.

RIGHTS AND OBLIGATIONS OF ALL USERS 
Relationships and processes with users (all users) 
Users are fully responsible of the relationships between each other. 
Web Site Content
To the extent permitted by law,
(a) ANAKARAAS.COM does not warrant that the Website will be free of errors, uninterrupted or secure, or that the use 
of the Web Site or any content, search or connection on the Website will provide certain results.
(b) ANAKARAAS.COM can not guarantee that any downloaded files from the Web Site will be free from viruses or other 
dirty or disruptive features..

Limitations of Liability

SOLUTION AND DISPUTE COURT OF CONFLICT• This Agreement is governed by the laws of the Republic of Turkey.• The Parties 
shall endeavor to settle all disputes arising out of the application and interpretation of this Convention first among themselves. 
Disputes which cannot be settled amicable, the settlement of Istanbul (Caglayan) Courts and Executive Directors are solely responsible
 for resolving disputes that can not be resolved.
INFORMATION STORAGE AND EVIDENCE AGREEMENT
• ANAKARAAS.COM system registered user information, proposals, comments / evaluations, etc.. shall be stored for at least three 
(3) years.
• The Parties declare, accept and undertake that in the event of any dispute arising from this Agreement, the trade books and 
records of ANAKARAAS.COM and the data stored in the systems of ANAKARAAS.COM shall be deemed to be conclusive evidence in accordance with Article 193 of the HMK No. 6100 in any dispute.

VIOLATION AND TERMINATION OF THE CONTRACT
• Responsible for any damages incurred by ANAKARAAS.COM and 3rd persons as a result of the users contrary to the provisions 
of this Contract. ANAKARAAS.COM may terminate this Agreement immediately upon unilateral without prejudice to the claims 
arising from this Agreement if it finds that the contract is violated.
• The parties will be able to conclude this Agreement at any time. The receivables of the parties from each other at the termination 
of the contract are not affected.

ARTICLE 5 - EFFECTIVENESS
